Thanks to a couple of well placed FOI requests & investigative journalism by Robert Todd over at the Law Times, we now know that the DOJ spent over 24 million on outside counsel in 2008.

A couple of observations here. First, even if we acknowledge that this is only a list of the top-10, it's hard not to notice a non-Canadian firm is was way out in front with 35% of the work delivered. And second, it seems odd that both Quebec and East Coast firms are missing from the list entirely. That may be reflected in the National firm numbers, but many regional Firm names are certainly absent.

In any event, I believe this is the first time I've seen a list like this assembled. It may open a can of worms, but certainly adds to Government transparency. A well deserved hat tip to the Law Times! Good journalism.

  1. Steve – while one of course applauds investigative journalism, this is low hanging fruit since volume III of the Public Accounts always had this information.
    If you look back you'll see that the US firms (Weil Gotshal and before that, Bartlitt Beck) have always led the pack because of the scale of the cases, and the fact that they weren't subject to federal discounted rates.
    And what exactly is the value to Weil Gotshal's client of the Softwood Lumber Treaty amendments negotiated under the shadow of the London Court of International Arbitration and which were signed by Jean Anderson of Weil Gotshal as counsel to Canada.
    The list may be misleading since it tends to bury local drug prosecution work which may account for significant amounts of local firm billings. That's where the western and Quebec numbers are.

  4. Part of the reason for outsourcing NAFTA cases to the American bar is that they are larger and more developed than their counterparts in the other two countries.

    Canada is catching up though, but it's also why I've said that renegotiating NAFTA wouldn't necessarily be a completely bad thing either.
