Anderson was charged with driving with a blood-alcohol content over .08. He was served with a Notice of the Crown’s intention to seek a greater punishment by reason of previous convictions (Criminal Code, s. 727(1)). As this was Anderson’s fifth impaired driving-related conviction, tendering the Notice meant that he would be subject to a mandatory minimum sentence of not less than 120 days’ imprisonment under s. 255(1)(a)(iii) of the Code.
