2017 FLSC Consultations on Proposed Amendments to the Model Code of Professional Conduct

Good afternoon,
I am writing to share the 2017 Consultation Report of the Federation of Law Societies of Canada’s Standing Committee on the Model Code of Professional Conduct (The report is available in English and French.). The proposed amendments address issues related to technological competence, the return to the practice of law by former judges, and an amendment to the rule on encouraging respect for the administration of justice. Feedback on any or all of the proposed amendments is welcomed.

Recognizing that the return of judges to legal practice after leaving the bench has implications not only for the regulators of the legal profession, but also for sitting members of the judiciary, their representative organizations, and the Canadian Judicial Council in May 2016, the Standing Committee shared a discussion paper exploring the issue. Feedback on a number of policy questions set out in the discussion paper was sought from law societies, the Canadian Judicial Council, the Canadian Superior Court Judges Association, the Canadian Association of Provincial Court Judges, the Canadian Bar Association, and a number of legal ethics academics. The Standing Committee considered the responses to the questions posed in the discussion paper and is now putting forward proposed changes to the Model Code for consultation.

The Standing Committee is seeking the feedback of Canadian law societies, representatives of the judiciary, the Canadian Bar Association, the federal Department of Justice, the Public Prosecution Service of Canada, individuals actively engaged in legal ethics issues, and interested members of the public on draft amendments to the Model Code.

The Standing Committee will carefully consider the substantive feedback it receives, making further changes to the proposed amendments as appropriate. The deadline for providing feedback on the proposed amendments is May 30, 2017.
Final amendments will be presented to the Council of the Federation for approval in December 2017 and then submitted to the law societies for adoption and implementation.

Vous trouverez ci-joint le rapport de consultation 2017 du Comité permanent sur le Code type de déontologie professionnelle de la Fédération des ordres professionnels de juristes du Canada (qui se trouve également en ligne). Les modifications proposées abordent des questions qui se rapportent aux compétences en matière de technologie, aux anciens juges qui redeviennent avocats, ainsi qu’à une modification à la règle sur le respect de l’administration de la justice. Nous serons heureux de recevoir tous commentaires sur une ou plusieurs des modifications proposées.

Reconnaissant que le retour des juges à l’exercice du droit après avoir quitté la magistrature a des répercussions non seulement sur les organismes de réglementation de la profession juridique, mais également sur les membres de la magistrature en fonction, les organismes qui les représentent, ainsi que le Conseil canadien de la magistrature, le Comité consultatif a présenté au mois de mai 2016 un document de travail qui aborde cette question. Les ordres professionnels de juristes, le Conseil canadien de la magistrature, l’Association canadienne des juges des cours supérieures, l’Association canadienne des juges des cours provinciales, l’Association du Barreau canadien et des experts en déontologie juridique du milieu universitaire ont alors été invités à faire part de leurs commentaires sur diverses questions de principe. Le Comité permanent a examiné les réponses aux questions qui étaient posées dans le document de travail et présente maintenant un projet de modifications au Code type qui fera l’objet d’une consultation.

Le Comité permanent aimerait avoir les commentaires des ordres professionnels de juristes du Canada, des représentants de la magistrature, de l’Association du Barreau canadien, du ministère fédéral de la Justice, du Service des poursuites pénales du Canada, des personnes qui interviennent activement dans les dossiers de déontologie en droit et d’autres membres du public au sujet des modifications proposées au Code type.

Le Comité permanent examinera attentivement les commentaires de fond qu’il recevra et apportera d’autres changements au projet de modifications s’il y a lieu. Les commentaires sur le projet de modifications doivent être reçus au plus tard le 30 mai 2017.

Les modifications définitives seront présentées au Conseil de la Fédération en décembre 2017 dans le but d’obtenir son approbation, puis aux ordres professionnels de juristes pour les faire adopter et mettre en œuvre.
